Welcome to Scrums.com ("we," "us," or "our") Talent Platform. This Terms of Use and the Recruitment Privacy Policy ("Terms") governs Your use of our talent platform and website ("Platform"), where you may create a profile, upload personal information, and apply for job opportunities.
By accessing or using our Platform, You acknowledge and consent to the processing of your personal information in compliance with applicable laws and regulations. This encompasses the collection, storage, and usage of your data as necessary to facilitate the functionalities and services offered on this Platform. Your profile and information disclosed will be shared with third parties for recruitment purposes such as potential projects, placements, interviews, and other opportunities with our clients.

If You do not agree with any of the Terms You should cease use of the Platform immediately and advise us to remove your profile and details.
DISCLAIMER AND LIMITATION OF LIABILITY
The use of the Platform is provided without any warranties or guarantees whatsoever. We do not guarantee employment or placement. We are not responsible for the actions of third parties who access your information through the Platform.
In no event shall Scrums.com be liable for any punitive, special, incidental, indirect, or consequential damages arising out of or in connection with Your use of the Platform.
We reserve the right to update these Terms from time to time. Your continued use of the Platform constitutes Your acceptance of any revised Terms.
We may cancel or terminate your access to any Platform at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
CONFIDENTIALITY
By using the Platform, You agree to maintain the confidentiality of any proprietary or confidential information you receive about Scrums.com and its clients.
You shall not use, disclose, copy, distribute, or exploit any confidential information for personal gain, competitive advantage, or any purpose other than applying for employment opportunities through the Platform.
You are responsible for taking all necessary precautions to safeguard and prevent unauthorised disclosure of confidential information.
Any unauthorised use or disclosure of Confidential Information may result in legal action, including but not limited to injunctive relief, damages, and other remedies available under applicable law.
NON-SOLICITATION& NON-COMPETE
You agree that you will not directly or indirectly solicit, engage, or enter into any employment, contract, or business relationship with any of our clients to whom you have been introduced through the Platform.
Any employment or placement with a client after an introduction by us shall be conducted exclusively by us.
This restriction shall apply for a period of 12 months following the last interaction with our clients.
GOVERNING LAW
Any dispute, proceedings or claim of whatever nature arising out of or in any way relating to these Terms and the use of the Platform shall be governed and construed in accordance with the laws of:
- England and Wales; or
- if you are based in South Africa, the laws of the Republic of South Africa shall apply.
DEFINITIONS & INTERPRETATIONS
Unless otherwise stated, the words and expressions shall bear the following meanings:
- “Confidential Information” includes but is not limited to business strategies, job postings, client identities and details, hiring processes, operational methods, financial data, and any proprietary or sensitive information disclosed through the Platform.
- “Platform” means the talent platform webapplication and Scrums.com Website;
- “Scrums.com”, “us”, “we”,“our” , “Group” means collectively, as the context of these Terms may be:
- Scrumsdotcom Ltd:for global use (including but not limited to Africa, Europe, United Kingdom, the United States); or
- SovTech (Pty) Ltd t/a Scrums.com: for use within South Africa;
- “Terms” means this Terms of Use and the Recruitment Privacy Policy;
- “You”, “Your” means the candidate or talent using the Platform to seek employment or other opportunities and in the context of these Terms, this means you, the person agreeing to these Terms.
